These Terms and Conditions govern your use of this website and the engagement of legal services provided by Bendul Zamrud, a law practice registered and operating in Malaysia. Please read them carefully. By using this website or engaging our services, you agree to these terms.

Definitions

  • "The Office" / "We" / "Us" means Bendul Zamrud, 30 Jalan Sultan Zainal Abidin, 20000 Kuala Terengganu, Terengganu.
  • "Services" means the legal services offered by the office, including estate administration, will and Faraid advisory, and bereavement advice meetings.
  • "Website" means the website accessible at https://bendulz.sbs.
  • "User" / "You" means any person accessing the website or contacting the office.
  • "Engagement" means a formal instruction to the office to provide legal services, confirmed by a written engagement letter.
  • "Content" means all text, information and materials published on the website.

Acceptance of These Terms

By accessing this website or submitting an enquiry, you confirm that you are at least 18 years of age and have the legal capacity to enter a binding agreement. If you are acting on behalf of another person or an estate, you confirm that you have the authority to do so. If you do not agree with these terms, please do not use this website or engage our services.

Description of Services

Bendul Zamrud offers three legal services relating to estate and inheritance matters:

  • Full Administration of Complex Estates (from RM 640)
  • Wills, Codicils and Faraid Advisory (from RM 355)
  • Bereavement Advice Meeting (RM 170)

Services are provided primarily to clients located in Malaysia. The office is based in Kuala Terengganu, Terengganu. Remote or cross-state engagements are accommodated where practicable. Legal services are available to persons aged 18 and over.

User Responsibilities

When using this website or engaging with the office, you agree to:

  • Provide accurate and complete information in all communications
  • Notify the office promptly of any changes to information you have provided
  • Not use this website for any unlawful purpose or in a way that violates these terms
  • Not attempt to access systems, data or communications not intended for you
  • Not transmit any material that is defamatory, offensive or otherwise objectionable

Intellectual Property

All content on this website, including text, design and structure, is the property of Bendul Zamrud and is protected by applicable Malaysian intellectual property law. You may view and print content for personal, non-commercial reference only. You may not reproduce, distribute or create derivative works from the content of this website without prior written consent. Documents prepared by the office for your matter are for your personal use in connection with that matter only.

Payment Terms

All fees are denominated in Malaysian Ringgit (RM) and are agreed in writing before any work begins. Payment terms are set out in each engagement letter. The office accepts payment by bank transfer and, where agreed, by cheque.

The Bereavement Advice Meeting fee is payable at the time of the meeting. Fees for estate administration and will preparation are invoiced as agreed in the engagement letter, typically in stages. No refund is available for work already carried out. If you terminate an engagement before completion, you are liable for fees in respect of work done to the date of termination.

Service-Specific Terms

Estate Administration

The scope of an estate administration engagement is set out in the engagement letter. Changes to scope arising from newly discovered assets, additional beneficiaries or legal complications will be communicated in writing and may affect the fee and timeline. The office does not undertake to achieve any particular distribution outcome — it undertakes to carry out the administration to the standard required by law.

Wills and Faraid Advisory

A will prepared by the office reflects the client's stated instructions at the time of preparation. The office takes no responsibility for changes in the client's circumstances after the will has been signed. It is the client's responsibility to review their will periodically and to instruct the office if a codicil or new will is required.

Bereavement Advice Meeting

The advice given at a Bereavement Advice Meeting relates to the information provided at that meeting. It does not constitute a complete legal opinion on the estate and does not create an ongoing engagement unless the client subsequently instructs the office in writing.

Legal outcomes in estate and inheritance matters depend on circumstances that the office cannot control, including the decisions of courts, registries and other beneficiaries. The office does not represent or warrant any particular outcome.

Limitation of Liability

To the extent permitted by Malaysian law, the office's liability to any client in connection with the services shall not exceed the amount of fees paid by that client in connection with the specific matter giving rise to the claim. The office shall not be liable for indirect, consequential or special loss or damage. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.

Confidentiality

The office is bound by solicitor-client privilege and professional confidentiality obligations under the Legal Profession Act 1976 and the Rules of Professional Conduct. All information shared in the course of an engagement is treated as confidential and will not be disclosed to third parties except as required by law or expressly authorised by the client in writing.

Termination

Either party may terminate an engagement on reasonable written notice. The office may withdraw from an engagement where required by professional conduct rules or where the client has provided materially incorrect information. Upon termination, the client remains liable for all fees incurred to the date of termination. Client documents will be returned on request, subject to payment of outstanding fees.

Dispute Resolution

In the event of a dispute, the parties will first seek to resolve the matter through direct communication. If a resolution cannot be reached within thirty days, either party may refer the matter to the Malaysian Bar's Client Complaints Bureau or to mediation before commencing litigation.

These terms are governed by the laws of Malaysia. Any proceedings shall be brought in the courts of Malaysia, with venue in Terengganu unless otherwise agreed.

General Provisions

  • Entire Agreement: The engagement letter and these terms constitute the entire agreement between the parties regarding the services.
  • Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.
  • Waiver: Failure to enforce any provision shall not constitute a waiver of the right to enforce it in future.
  • Assignment: You may not assign your rights under these terms without the office's prior written consent. The office may assign its obligations to a successor practice.
  • Notices: Formal notices should be sent by registered post or email with read receipt to the addresses set out in section 14.

Changes to These Terms

These terms may be updated from time to time. The updated date at the top of this page will reflect any change. Where the change is material, the office will notify clients by email where contact details are held. Continued use of the website following a change constitutes acceptance.
